She loved gardening.

She can make anything grow.

Narrator: the two are very close and see each other every two weeks.

Wilson: she was like my best friend.

She was...the best mom I could ask for.

Narrator: diane is also a beloved grandmother.

Wilson: my children absolutely adored her.

She spoiled them rotten.

Mom, I saw this on your front step.

Oh, great!

I was hoping this would arrive today.

Oh, look at that.

She loved my kids so much

That, you know, everything was for them.

My mom always called her coin collection

So that they would have help with college

Or buying a car, or whatever they needed.

I don't know which ones were worth the most money,

But I know that she had a lot of morgan dollars.

Narrator: two weeks later,

September 29th,

It's diane's turn to visit tami.

I texted her first thing in the morning, you know,

Asking her what time she was gonna be over

Because sometimes it took her three hours,

Narrator: so, when her freespirited mother doesn't reply,

Tami thinks she must be en route or tied up back home.

Throughout the morning, you know, with no response.

Tami's husband, mike, suggests calling the local hospitals.

But there's no one listed under diane's name

Or matching her description.

♪♪

So tami resolves to wait for her mom to resurface.

But, a few days later,

Tami can't wait any longer.

I lived about three and a half hours away from my mom.

You know, I had kids and I was busy

And couldn't break away, you know.

That's why it took me so long to get over there.

Mike thought maybe she drove off the road or something.

So he was driving like five miles an hour,

Looking for places, you know, she may have drove off the road.

Narrator: there's no sign of diane's car anywhere en route.

And it's not outside her home, either.

It's locked.

Right when I walked in the door,

I was just overtaken by the smell.

I just kept telling myself it was rotting food

'Cause there was some food on the counters.

It was a horrible smell.

Narrator: the smell seems to be coming from diane's bedroom.

When he got back to her bedroom, he told me, he says,

"No, tami, get outta here.

There's blood everywhere."

'Cause there's just blood smeared all over it.

This crime scene was horrific.

The stage of decomposition she was in

Was a clue that we were already five to seven days behind

In the investigation.

I wanted to interview tami because it was vital to get

Her responses to what she saw.

Narrator: anything out of place could be a clue,

Starting with diane's car, which is not in the driveway.

Tami made it a point to tell us that the car was not there,

Which led us to believe that our suspect left with a car.

Can you describe the car?

It was -- it's a green audi.

[ Radio chatter ] narrator: police immediately

Put out a bolo on the missing vehicle.

-And... -Tami also tells the detective

About something belonging to diane that's valuable

And easy to steal.

Where did she keep the coins?

She kept them in a cupboard.

Now, diane's prized coin collection is missing.

Investigators search the property

For any potential clues.

Knutson: I saw a pair of men's boots.

The information that we had, at that point,

Is that she lived alone.

We found a walmart receipt in the trash can

Inside diane cunningham's residence.

Fits our timeline.

The walmart receipt was for the 28th of september 2014.

She was likely alive at that point.

That's weird. Look at the time.

The time was at 5:00 in the morning

And that was certainly suspicious to us

Because the common person does not shop at 5:00 in the morning.

Narrator: unless the receipt came from diane's k*ller.

Detective knutson heads to the walmart, 20 minutes away.

He hopes their surveillance cameras

Were rolling that morning.

And that, nine days later, any footage hasn't been deleted.

What awaits him are the final moments

Of diane cunningham's life.

And anybody that may have been accompanying her.

Narrator: a moment later, a customer steps into view.

The customer is an elderly woman with white hair.

It's diane.

We see diane is up at the cash register

And she's paying for her items.

I remember seeing her pink fingernails...

And I recalled that, when we recovered her remains,

She had these pink fingernails.

At that point, the human element of it starts to get to you

And you feel so sad,

Just knowing that these are probably the final hours

Before she was brutally m*rder*d.

Narrator: she's also wearing the same clothes she died in.

But diane appears to be alone.

Pause.

She has the potting soil that we saw at her residence.

She seemed like she was doing everything

On her own free will

And this was just a casual trip to the walmart.

Narrator: and, yet, it's 5:11 in the morning.

Hoping the parking lot will reveal more.

They spot diane's audi in the bottom of the frame.

It's the only car in the lot.

Wait, what was that?

It's obvious, at that point, that there's someone

Inside that car. We just don't know who.

And then, we see what appears to be a male subject

Exit the passenger side.

And he's just standing there.

What is he doing?

♪♪

We're thinking that this could be the k*ller.

♪♪

Narrator: at 5:13 am,

Diane exits the store.

Okay, that's her, coming back out.

♪♪

Knutson: they meet by the rear portion of her vehicle

And they appear to engage in conversation.

And then, the man assists her

In loading the items that she just purchased into her car.

So they rewind the video...

...until diane's car first pulls into frame.

Okay, so there's the audi.

The man grabs a cart and wheels it back to the car.

He then unloads something from the trunk

And puts it in the cart.

There's a brief exchange

Before diana pushes the cart towards the entrance,

Leaving the man behind.

A few minutes later,

The man heads towards the entrance of the store.

Is there an interior camera?

[ Ominous chord strikes ]

At 4:49 am,

He walks in.

Pause.

Knutson: the man appears to be in his 30s or 40s.

He's balding on the top of his head.

He has a full-grown beard.

He's got a white t-shirt on, bluejeans,

And he's wearing boots.

[ Ominous chord strikes ]

Narrator: maybe the same boots found outside diane's home.

[ Suspenseful music plays ]

Play.

Narrator: the man then turns to his right and walks out of frame.

♪♪

I'm thinking, in my head,

"Is this the guy that k*lled diane cunningham?"

And I'm thinking that it is.

[ Ominous chord strikes ]

Narrator: investigators now have an image of their prime suspect.

[ Suspenseful music climbs, chord strikes ]

Back at the station, detective mclaughlin

Is getting a formal statement from tami wilson.

With no sign of forced entry,

Investigators believe diane knew her k*ller

And hope tami can narrow down the suspect list.

She gave us a name: joel kevin brown.

Kevin was a friend of my mom's for years

And he was having some hard times,

So she let him stay with her

And he stole her money.

She was just heartbroken

Because that was a good friend of hers

And she couldn't believe that he did that.

Narrator: officers immediately

Run a background check on kevin brown

And turn up a troubling past.

He was wanted by the department of corrections

For failing to appear.

Narrator: and he has a history of as*ault charges.

And she just happened to stop and pick him up.

Narrator: detectives can now place brown at walmart within a few hours

Of diane cunningham's last sighting.

We're investigating

The m*rder of diane cunningham.

Did your ex-husband know her?

Yeah. Yeah, he did.

He's staying with her.

She explains that kevin brown had been staying

With diane cunningham and that, at one point,

She actually kicked him out of the house.

At that point, we determined that he was homeless.

The department puts out a person-of-interest bulletin

I'm coming down right now.

Narrator: they've got their prime suspect in custody.

And...

Brown has changed his appearance,

By shaving off his hair and beard.

He acknowledged that he knew diane.

He acknowledged that he had stayed with her in the past.

[ Eerie music plays ]

Narrator: his story about swiping diane's cash

Is consistent with tami wilson's.

Mm-hmm.

♪♪

Kevin also admits to being at walmart

Within hours of diane's early-morning shopping trip...

[ Suspenseful music plays ]

...but insists he never saw her there.

But police are pretty sure they've caught brown

On the walmart footage on the 28th,

Before he cut his hair.

When he asked him where he was at on september 28th,

He said he was at his homeless shelter

With his friend anderson.

On his outstanding warrant

And keep him on ice while they check out his alibi.

It doesn't take long to track down brown's friend anderson,

At the shelter where they both live.

When was the last time you saw kevin brown?

We talked to anderson.

He couldn't recall exactly what day, what time.

Being that they're homeless,

They don't really have a schedule,

So, he wasn't able to inclusively say

That kevin was there on the 28th.

Thanks for your time.

Narrator: which means that brown still tops the suspect list,

But investigators will need more evidence to keep him there.

And they hope it's just arrived, on the back of a trailer.

Diane cunningham's car was brought back

To the state of washington and to our holding facility.

♪♪

The biggest piece of evidence that we recovered

Was a receipt for the washington state ferry.

♪♪

Narrator: it's dated september 28th at 6:43 pm.

We realized that this is just hours after

When we believe diane cunningham was k*lled.

Narrator: knutson knows every border crossing is outfitted

With surveillance cameras,

Which could confirm who was driving diane's car.

Investigators make the 70-mile journey to collect the footage.

I knew, based on previous investigations,

That that footage is gonna give me a shot

Right into the front of that car,

Right through the windshield.

When we contacted the washington state ferries,

We were able to give them the license plate.

Which they ran.

The security officer has already queued up the video.

She goes around, gets in the driver's side of the vehicle.

The male that's standing on the passenger side of her vehicle

Appears to wait for the door to unlock.

He gets in.

Narrator: the headlights go on.

And diane's car pulls away.

I wanna see if the man goes in the casino.

At 3:51,

Four minutes before diane left,

They find the suspect, walking out.

It's apparent, in the video, that he isn't gambling.

He's just watching her gamble.

At one point, he takes his hat off...

...and we see that he's bald on top.

At this point, we're able to get

Good, clear footage of what this guy looks like.

Narrator: knutson compares the image to kevin brown's booking photo.

Knutson: we see that he has a full-grown beard.

We see that he's a larger guy.

Narrator: this man is bigger than kevin brown,

With a completely different face.

[ Sinister music plays ]

We really thought we had our guy.

Narrator: it's not kevin brown at the casino,

Not kevin brown at walmart,

And not kevin brown at the ferry crossing.

We thought, "well, where do we go from here?"

Narrator: detective knutson returns to the sheriff's office

To pull kevin brown back into the interview room.

♪♪

He's no longer the prime suspect,

But having known diane for years and lived with her,

Brown might just recognize the man with her in the casino.

During this interview,

I've got one of my detective counterparts outside,

Listening in and taking this information

And checking our local database.

He was able to pinpoint a blue dodge pickup.

It's registered to ari king.

Narrator: tracking him on video was challenging enough,

But, now that they have a name,

They must catch ari king before he hurts anyone else.

And the picture on the side of the box

Matched the boots that I recovered

At diane cunningham's residence.

Waterhouse: at this point in the investigation,

We've collected all the evidence that we possibly could.

Now, it's a matter of trying to locate ari king.

We knew that diane cunningham's car had been recovered

Down in malheur county, oregon, so we believed that ari king

Was probably down at malheur county, oregon.

Narrator: that's 13 hours away, but worth the trip,

If they can apprehend king and bring him to justice.

Detectives knutson and waterhouse

Head off on the long trip.

I had created flyers to pass out.

Most people in rural areas are gonna recognize somebody

From outside the area.

Narrator: when they arrive in the town of juntura,

One of their first stops is at a neighborhood café.

I put the flyer down to show the owner.

"Hey, have you seen anybody looking like this?"

And I'll never forget it: she looked down at the flyer

And she put her hand over her heart

And she took a step back and her face just flushed.

I mean, it's like she'd seen a ghost.

Narrator: she says a man matching the description

Has been in a few times, but introduced himself as tom.

He explained that he was out of money, but,

He wanted to pay for his meal with some coins that he had.

[ Sinister music plays ]

Narrator: detectives know they're from diane's stolen collection.

This was just one more nail in the coffin of evidence

That ties him to being diane cunningham's k*ller.

Knutson: she further explains that she's actually been bringing him food.

He's been staying under one of the horseshoe bridges.

They call local law enforcement to meet them there.
