It was a very brutal, graphic scene.

This could have been a burglary or a robbery gone bad.

Kjonaas: why would somebody want to hurt him?

He seemed to be a good father,

A good friend, a good businessman.

Narrator: police need a witness

That can offer crystal clear answers.

Fargo, north dakota, 7:30 a.m.

Forty-nine-year-old dentist philip gattuso

Is getting his daughter, sarah, ready for the day.

Let's get you some cereal hooked up here.

Without a doubt, she was very happy,

Especially when she was with her dad.

She was very joyful.

Do you want daddy to help you a little bit, honey?

Okay.

What color do you want to do the antlers?

Pink or purple.

That's a great idea.

I'll help you color just a little bit more.

Philip's daughter was just really the center of his life.

How's that? Pretty good?

Narrator: daddy and daughter are especially tight

Because they shared a recent tragedy.

Just 7 months ago, philip's wife, valerie,

Passed away after complications from heart surgery.

Philip was just, kind of, over his --

Over his heels in love with valerie.

They were very smitten.

They kind of hit it off really well,

Had a -- had a real romance.

I know he was hurting tremendously

From his wife's passing.

It crushed him. Absolutely.

Her death crushed him.

I could see the pain.

Here's your bag and your coat, sweetie.

Every time you saw his daughter, sarah, he --

You saw a reflection of his wife.

He loved his wife.

And he wanted to remember, um,

And bring honor to wife through his own life

And just focus on raising his daughter.

Narrator: philip has a lucrative periodontal practice.

But lately, he's been scaling back his office hours.

It didn't allow him a lot of freedom

To be the kind of dad that he wanted to be.

He really wanted to thrust and pour all of his energy

Into being the best father he could possibly be for sarah.

Narrator: philip has a busy day ahead,

Starting with a 10:30 a.m. Conference call.

But first, he takes sarah to day care.

Burdick: this is a place she regularly went.

He would take her in the morning and pick her up

In the late afternoon.

Narrator: but at pick up time, philip is a no-show.

[ Phone ringing ]

The staff tries to reach him repeatedly,

But there's no return call.

How's it coming, sarah?

As afternoon turns to evening,

The day care reaches out

To philip's emergency contact.

The day care center had called julie willard,

Because she was on the call list.

Family friend julie gets sarah safely to a friend's house,

Then heads over to philip's condo

To check on him.

Philip!

Burdick: she climbed the backyard fence,

Because the front door was locked.

Looked through the window,

Saw that his porsche was gone.

Narrator: which means philip is probably not home.

But julie looks around anyway.

She went through the back door in the garage,

Which was unlocked, and then went into the house.

Narrator: kids can be messy,

But this is something entirely different.

Philip, are you okay?

Burdick: there were things all over the place.

Things were strewn about.

Drawers, uh, upturned.

There was a very small amount of blood

On the floor in the --

Near the kitchen dining room area.

Narrator: inside the bedroom,

Julie discovers philip is indeed home.

[ Screaming ]

I need an ambulance right away. I don't know

If he's still breathing.

Narrator: but as emts will soon discover,

Philip gattuso is already dead.

[ Police radio chatter ]

It was after 8:00 in the evening

When I received the first initial call from a sergeant,

Who stated that they had a deceased person in the house.

It was a very brutal, graphic scene --

Homicide scene, very brutal scene.

Narrator: robbery seems like the obvious motive.

Lies: all of the kitchen cupboards were open.

Some of the closets appeared

To have just been opened up and items grabbed

And just dropped right in front of the closet,

On the floor.

[ Police radio chatter ]

They're usually in the house looking for quick,

Fast items to grab.

And then they're out.

Narrator: but this thief has been unusually thorough.

Taken everything.

Lies: all the electronics -- the tvs, computers, jewelry.

There was... Pretty much anything of value

That was in the house electronic-wise

Was taken and gone.

Narrator: whoever did this took their sweet time

Plundering valuables,

Suggesting this is the work of a seasoned criminal --

A criminal with no qualms about shedding blood.

It was pretty clear that there was a struggle.

Some sort of heavy object.

Philip gattuso was k*lled by a blunt object

That was very consistent with a hammer.

This could have been a burglary

Or a robbery gone bad,

That mr. Gattuso had interrupted this person

Or persons when this happened.

Narrator: the missing porsche,

Worth $20,000, now makes sense.

It may have been the main target of the robbery.

The most significant piece of evidence

Missing that was identified right away was his porsche.

Narrator: crime scene technicians sweep the scene for clues

And notice an odd detail.

Lies: there was no screens that were damaged.

There were no doors that were forced open.

There was -- there was absolutely no sign

Of forced entry.

Narrator: which means philip likely let the k*ller

Into his home willingly.

They can't rule out someone close.

While the csi unit continues processing the scene,

Detectives break the terrible news

To gattuso's family members,

All of whom live out of state.

Yes, hello.

Can I speak to mr. Kirkpatrick, please?

The first call they make is to philip's in-laws...

Yes, sir. This is, uh, detective kjonaas

From the fargo police department.

...gene and sharon kirkpatrick.

I'm sorry to say that I have some very bad news

About your son-in-law, philip gattuso.

Unfortunately, his body was found deceased

At his condo this evening.

Kjonaas: gene and sharon were both very upset by philip's death.

They were compassionate and,

Um, very sad for philip's daughter.

Narrator: the kirkpatricks have only recently buried their daughter.

Now, they've lost their son-in-law too,

Leaving their beloved granddaughter an orphan.

Burdick: when told of philip's death,

The kirkpatricks, uh, got in the car

And immediately came to fargo.

We can get there as soon as possible.

Narrator: but they live nearly 900 miles away, in oklahoma,

And the journey will take them at least 24 hours.

Grandma and grandpa are coming tomorrow to visit you.

That's exciting, isn't it?

Meantime, julie takes care of sarah,

Who doesn't yet understand what's happening.

Do you want the light off or on?

On.

Family and friends aren't the only ones mystified

By philip's m*rder.

Because philip didn't have a criminal past

And wasn't on the police radar,

My initial thoughts were,

"Why would somebody want to hurt him?"

He seemed to be a good father,

A good friend, a good businessman.

Narrator: with forensics at a dead end,

Police start canvassing the neighborhood.

But nothing else out of the ordinary, you know...

Well, what we're really interested in at that point

Is seeing if there are any witnesses in the area

That can help us try to figure out what happened.

We believe that he was k*lled between 8:15,

When he dropped his daughter off

At her day care center, and 10:30 a.m.,

At the time he was supposed to make a business call --

A business call that -- that was never made.

Thank you. Thank you very much.

Narrator: but no one saw or heard anything unusual that morning.

For police, the clock is ticking.

Ahlfeldt: it's giving individuals who committed the crime time

To hide their tracks,

Time to run, time to get away.

Narrator: their only hope is to find another kind of witness,

One that's always watching.

Ahlfeldt: pulled surveillance footage is, uh,

Probably the best witness that you can have

Because you're actually seeing a crime happening.

Narrator: philip's condo is in a commercial area.

And where there are businesses, there are cameras.

Kjonaas: if we can get surveillance video in a homicide investigation,

That footage can be priceless.

It can identify the k*ller.

It can provide a timeline.

Sometimes, it can provide a motive.

Narrator: police are about to get their first video clue

To a m*rder case

That will only get stranger and stranger.

Narrator: twenty-four hours after a brazen criminal k*lled

Family man philip gattuso

And stole his porsche,

Police go hunting for leads

In neighborhood surveillance footage.

Take it back to 7:20.

Good quality images of people in the area,

Of vehicles in the area...

Can you get that angle on university drive?

Narrator: the widest view is from a mcdonald's surveillance camera

On the same road as philip's condo.

Plenty of cars pass,

But none that resemble philip's porsche.

Investigators expand their search for cameras

And find what they're looking for at the bowling alley

Across the street from philip's condo.

If anyone came or went from philip's garage,

This camera saw them.

The bowler has surveillance cameras

Positioned outside of the business.

And one in particular was facing the northeast direction,

Into their parking lot.

You can see the footage right over here.

Great.

Narrator: in the bowling alley's back room, lieutenant ahlfeldt

Queues up the surveillance footage to 7:29 a.m.,

When it's still dark.

Shortly after, headlights appear on the screen.

Ahlfeldt: a dark-colored pickup truck with what appears to be,

Uh, a trailer for hauling a vehicle

And it's pulling off of 26th avenue

Into, uh, the north parking lot of the bowler.

It's turning in to position itself to park northbound.

And that truck just turned its lights off.

Do you recognize that truck?

No, not at all.

What time do you open in the morning?



I thought that was strange, uh, that it's past the time

That someone might be trying to take a nap overnight.

And, uh, you're sitting facing towards

Where the crime occurred, uh, with a trailer to haul a car.

I thought that that was very suspicious.

Narrator: investigators hope the owner of the bowling alley

Saw something more...

You know what, actually, now that you mention it...

The owner, who was there doing clean up in the parking lot,

And he said he specifically remembers on the 26th,

That morning, there was a black pickup

With a trailer on it.

At that time of the day,

I never see anything in the parking lot.

Burdick: he noticed the pickup truck

That was pulling the trailer

Had an oklahoma license plate on it.

Kjonaas: it was noted to be fairly significant

Because philip's late wife, valerie,

And her parents, gene and sharon kirkpatrick,

Were from oklahoma.

Narrator: philip had spent plenty of time

There before and after valerie's death,

So it's possible he had made friends

Or enemies in oklahoma.

Detectives turn back to the footage

From the bowling alley parking lot.

I was frustrated that I couldn't see more, uh,

From the -- the grainy footage.

It was very hard to make out distinguishing features.

We weren't able to see the license plate on the truck

Or the flatbed trailer.

Narrator: but at 7:46 a.m., Almost 20 minutes

After the pickup enters the parking lot,

They do spot something.

The truck lights flash.

Hang on. What's that?

Go back 20 seconds. All right.

And as the morning gets brighter,

They can just make out a shadow moving.

Right there. That's a person.

Kjonaas: we see an individual exit

The truck that was holding the flatbed trailer.

And this individual begins to walk through the parking lot,

Toward philip gattuso's condo.

In the back of my mind, what I thought was,

"This is the person that took mr. Gattuso's car and --

And more than likely, k*lled mr. Gattuso."

Narrator: if there's any hope of identifying

This mystery man,

Detectives will need a better view.

Once again, they scour the area for cameras.

At an a&w restaurant

Behind philip's condo complex,

They find what they're looking for.

It was a direct path from the bowler parking lot,

Past a&w, a direct line right to philip gattuso's house.

Narrator: they rewind the a&w footage to 7:47 a.m.,

Just after the man leaves his truck.

Then, they wait for a glimpse of their suspect.

Ten seconds into the clip,

There's movement in the back of the frame.

Right there.

You see that?

Lies: you could actually see the legs

Of an individual walk behind the business.

Ahlfeldt: this footage filled in the piece of the puzzle

That, uh, the individual

That more than likely committed the crime

Had walked behind the a&w, uh,

And, uh, through that area

Into the condo area where mr. Gattuso lived.

Narrator: there's not much to see --

Just that he or she is wearing light-colored pants

And dark shoes.

It's very little to go on.

Twenty-four hours after the discovery

Of their son-in-law's body,

Grandparents gene and sharon kirkpatrick

Arrive at fargo police station

To pick up their young granddaughter, sarah.

Sir, do you mind if I have a word with you?

Lies: there was no doubt that their granddaughter

Was very important to them.

Narrator: officers ask gene if there was anyone in fargo

Or back in oklahoma

With a motive to harm his son-in-law.

But gene let slip that his son-in-law

Did have a secret vice.

And maybe, just maybe, that's what got him k*lled.

Narrator: while police struggle to track down

The k*ller of widower dad,

Philip gattuso, his father-in-law

Reveals a possible m*rder motive.

Lies: his gambling could potentially

Have contributed to his death

If he would have been in debt to somebody.

Narrator: almost 30 hours after gattuso's body was found,

Police track down his gambling buddies.

Mr. Williams?

Detective lies.

Do you mind coming with me so we can speak

In private for a moment?

They all seem shocked by gattuso's death.

But there's one fellow gambler they can't find.

Maybe you've seen this gentleman here.

His name's carl lucas.

Does he, uh, ring a bell to you at all?

He look familiar?

Again, I see a lot of faces throughout the day.

Doesn't really stand out to me, no.

Lucas isn't answering his cell.

And when police show up at his house,

They find the place practically deserted.

His disappearance, just one day after his friend's m*rder,

Raises more than a few eyebrows.

Maybe he's the shadowy figure

Seen skulking around philip's condo

Right before the m*rder.

By now, carl lucas may have fled town.

Three-one-three, negative.

Narrator: and if he's in gattuso's porsche,

He's going to be very hard to catch.

While the search for lucas continues,

Police go door-to-door

In a wider sweep of the neighborhood.

Kjonaas: we were hoping to gain information from anyone

Who may have been in the area,

Seen something, um,

Heard something, talked to somebody.

Hi, I'm detective lies.

Narrator: in an apartment next to the bowling alley,

They find someone who saw something unusual

On the morning of the m*rder.

There was a man out behind my apartment building,

Fiddling with a truck.

He was loading a porsche onto a rickety trailer,

Which seemed like a strange way

To transport such a fancy car.

Burdick: she described herself as a nosy person,

And so she created an excuse

To go out and talk to him.

What she did is run around the house,

Look for some garbage, and walk outside

To the garbage area

So that she would have an excuse

To walk by this guy

And ask him what he was doing.

Wow, that's a nice car.

It's not mine.

Uh, some guy got it on ebay. I'm just makin'...

Narrator: the witness recalls the man was in his forties.

Take it down south...

Wearing a green jacket and light-colored pants.

But she can't be sure if it was carl lucas or not.

He always kept the trailer

Or the car between himself and her,

So her view of him was somewhat limited.

Have a good one. You too.

Narrator: detectives now have a pivotal witness

And a prime suspect.

But as day two of the investigation wraps up,

[ Phone rings ]

Police get a game-changing call.

Lieutenant ahlfeldt.

It's the last person they expect...

Hey, how...

Carl lucas.

[ Whispering ] it's carl lucas.

He's a long-haul trucker, he says,

And claims he was over 200 miles away in minnesota

At the time of philip's m*rder.

His alibi must be checked out.

So, you have to follow everything that comes in.

You have to see things through to the end.

Narrator: police call the trucking company to check gps records.

Sure enough, the data confirms

That lucas was out of state at the time of the k*lling.

Carl lucas is not their man.

Detectives go back to the bowling alley surveillance

And queue up the tape to 10:45,

Fifteen minutes before the neighbor

Said she encountered the suspect.

The footage is now their best hope of finding the k*ller.

The truck and trailer are still right

Where the driver left them at 7:29 a.m.

In the back of my mind I was thinking,

"Man, if I see a silver porsche drive

Either up the street or out on that trailer,

This is our guy."

Narrator: at 10:52 a.m....

What's that?

...they spot something.

Kjonaas: you see a silver vehicle,

Looks like a porsche with a black top,

Slowly driving, uh, to the east.

Narrator: right past the bowling alley.

I'm going to back it up and see if it goes

In that garage over there.

They watch to see if the porsche turns off the road

To the back of the apartments.

But the footage skips just at the vital moment.

There's no telling if it turned off into the garage.

Officers keep watching,

Eyes trained on the truck and trailer.

At 10:56 a.m., Just minutes after the porsche passes by,

The driver pulls out.

This time, the camera doesn't miss a beat.

Ahlfeldt: and you can see, uh, the top of it

Pull into the parking lot

Of that apartment building.

Narrator: half an hour later, at 11:31 a.m.,

The pickup reappears from the garage.

And now, it's towing a car.

That's got to be our man.

Police enlarge a still of the suspect's

Vehicle leaving the area.

We release that to the press

In hopes to generate some leads from somebody

Who might be able to help us track down this vehicle.

[ Phones ringing ]

Narrator: just 2 hours after the media run the images,

The phone lines at the station are ringing off the hook.

Officers begin to chase up new leads,

But one call from a potential eyewitness

Instantly stands out.

And if there's surveillance footage

To back up the caller's claim,

It could finally bring the k*ller's face into focus.

Narrator: thirty-six hours after widower dad philip gattuso's

Body was found,

The story is playing on news all over the midwest.

Fargo is still reeling.

He had a lot of friends.

People loved him that knew him.

There were a lot of people that were very upset.

Narrator: and all the coverage does generate

One promising new lead.

We did receive a significant tip from an individual

Who'd been at a rest stop on i-29 in south dakota.

Narrator: the rest stop is just an hour's drive from philip's condo.

Kjonaas: we were told by this individual that

He'd had a conversation with a person

At a rest stop driving a dark pickup,

Pulling a flatbed trailer, and hauling a car.

How far are you goin'? Uh, just down the highway.

I'm delivering it for a guy...

Narrator: the tipster thought it was suspicious

That the man kept adjusting the tarp covering the car.

Curious, he'd taken a look underneath

And saw it was a silver porsche --

A perfect match for philip gattuso's stolen car.

Have a safe journey. Right.

Detectives head straight out to follow-up.

Burdick: as it turns out,

This rest stop in south dakota

Is literally bristling with cameras --

All kinds of surveillance cameras.

Narrator: they pull the video

And bring it back to headquarters,

Then queue it up just before noon,

When the witness said he encountered the man.

At first, it's just another empty parking lot.

But at around 11:40 a.m.,

A dark pickup enters the frame.

Lies: a truck pulled in.

It's pulling a trailer with a tarp over an object.

Narrator: it's just like the truck

And trailer seen on the bowling alley video.

Kjonaas: the driver of the truck pulling the car exits,

Begins to walk around the trailer,

Appears to maybe be adjusting the tarp covering the vehicle.

Someone's coming over.

At that point, he engages in conversation

With an individual.

That's our witness.

It's a great moment because in watching this footage,

We're able to corroborate the information

That we were given.

Narrator: sixteen minutes after the vehicle first appears,

The driver walks away from the truck.

He's coming.

Kjonaas: we see the individual

Who had been driving the pickup

Towing the car

Walking towards the shelter

Of the rest stop carrying something in his hand.

Zoom in on him.

Narrator: he's middle-aged,

Wearing light pants and dark shoes,

Just like the man in the garage back in fargo.

Looks like our guy.

'Cause it was the best video of the driver of this vehicle

That we had seen to this point.

Narrator: the image is good,

But it's about to get a whole lot better.

Police switch to the cameras inside the lobby

And strike gold.

The footage is in full color.

Kjonaas: we see the driver look up at the camera

And then continue into the rest stop.

We got him.

Kjonaas: the quality of the video was fantastic,

So at that point, we knew we had an image of the person

Who we wanted to talk to in regards to this case.

Narrator: the man is carrying a black garbage bag,

And is wearing a green jacket and gray pants --

A perfect match for their suspect.

What's that on his leg?

Zooming in reveals an ominous detail.

There was something on his pant leg

That appeared to us

As if it could have been a blood stain.

Narrator: the man disappears from the camera's view.

He returns a few minutes later, wearing fresh clothes.

In our opinion, the reason he stopped at the rest area

Was to get out of the clothes

That he had committed this homicide in,

To change clothes

So that he wouldn't draw attention to himself

When stopping for gas or food.

Narrator: if police can get a clear shot of the license plate

On the trailer as it leaves,

It will be fast work to track the suspect down.

They find a single traffic camera

On the corner of the rest stop.

They queue the video to just after 12 p.m.,

When the suspect exits the building.

Sure enough, at 12:08 p.m.,

The camera picks up blurry images

Of the trailer pulling away.

Burdick: it gave us a direction.

The vehicle was traveling

South on the highway, towards oklahoma.

Narrator: but detectives can't decipher the license plate.

After we obtain the footage of the vehicle and trailer

Leaving the rest area,

We submitted that footage to be enhanced.

We were able to determine

That the license plate number on the trailer

Was "e"-eight-five- one-seven-nine-six.

Narrator: it's an oklahoma plate.

They can also now clearly see a u-haul sticker.

It's a rental.

Lies: as far as homicide cases,

That was, like, a golden nugget.

That gave us the opening

We needed to help identify this person.

Narrator: the k*ller has crossed state lines,

So fargo pd reaches out

To the oklahoma state bureau of investigation for help.

We asked u-haul to identify who had, in their possession,

An auto-transport trailer the day of the m*rder.

[ Phone rings ]

Special agent hamilton.

U-haul was able to return two names to us of people

Who fit that description.

Return date?

Narrator: the first man's vehicle had texas,

Not oklahoma plates.

The second man, he had rented an auto transport

From a u-haul store in oklahoma city

On october 23rd of 2009,

Which was 3 days before mr. Gattuso was k*lled.

Narrator: the man returned the trailer

Over 24 hours after the crime.

More than enough time to drive back

To oklahoma city from fargo.

Narrator: investigators are now closing in on their suspect,

But the case is set to take one last dramatic twist.

Narrator: thanks to enhanced license plate footage,

Investigators are closing in on philip gattuso's k*ller.

Detective lies travels down to oklahoma

And the u-haul where the suspect rented the trailer

Used to steal his victim's porsche.

The trailer has only just been returned,

And the store has a surveillance camera.

The whole transaction has been caught on tape.

Hamilton: I see a man walking in and bringing paperwork with him.

He's leaning on the counter.

Narrator: sure enough, it's the same man

From the rest stop footage.

Hamilton: it's striking at how normal he's acting,

Which is, I think, really disturbing.

Narrator: and now, finally, they have a name.

The man who had rented this trailer was michael nakvinda.

Look at this.

Narrator: investigators run a background check.

Michael nakvinda is a man who's in his early forties.

He is a white male, about 6'1",

Who lives in the oklahoma city area.

He was working as a handy man, odd jobs here and there,

And lived with his handicapped mother.

Narrator: but he has a disturbing record.

Unauthorized use of a motor vehicle,

Concealing stolen property,

r*pe, kidnapping, armed robbery,

Burglary...

[ Sirens wailing ]

Narrator: investigators head straight to nakvinda's home.

Osbi, fargo police, oklahoma city police

ex*cuted the search warrant the morning of halloween,

October 31st, 2009.

Narrator: the black truck from the video

Is sitting in the driveway.

Police won't be taking any chances

Bringing the suspect in.

[ Door kicked in ]

[ Yelling ]

We've continued to try and find the evidence --

The car, the jewelry

And all the valuables taken from the gattuso house.

We searched his residence. We didn't find anything.

Narrator: but news of nakvinda's arrest spreads quickly through oklahoma

And a final witness emerges.

Lies: we had a gentleman who was watching the news recognize him.

He said, "he just rented a storage facility

From me a couple of days ago."

Hamilton: we obtained the warrant

At about 2:30 in the morning.

The storage facility is locked,

And so we have to get a saw to break the lock,

And we lift the door on the storage unit.

And you can see a tarp covering

What appears to be a low vehicle.

And we pulled the tarp back, and there was the porsche.

It's the porsche, boys.

Yep, think we got her.

Lies: the porsche was full of property --

Computers, televisions,

Cameras, jewelry,

Personal affects that had phillip gattuso's name on them.

Narrator: but the most damning piece of evidence

Is one of the smallest and most gruesome.

On the passenger floorboard, there was a hammer.

And the head of the hammer had dried blood

And hair attached to it.

We take the hammer.

We send it away for dna analysis.

We find philip's blood on it.

Narrator: but a critical question remains.

Why does michael nakvinda drive all the way

Up to fargo, north dakota,

k*ll philip gattuso,

Take his car and his things, and drive back to oklahoma?

Hamilton: we still did not have any connection

Between the gattusos and michael nakvinda.

Narrator: investigators want answers, but the suspect isn't talking.

Mr. Nakvinda invoked his miranda rights,

Which he is entitled to do.

And so he did not consent to an interview with us.

Narrator: but nakvinda is powerless to stop others from talking.

And the person who knows him best,

His mother, quickly makes a stunning disclosure.

She reveals that mr. Nakvinda

Is the handyman for gene kirkpatrick,

Who is mr. Gattuso's father-in-law.

Lies: the tie between nakvinda

And gattuso is kirkpatrick.

Kirkpatrick is the common denominator

Between the two.

So, therefore, he had to have played some role in this.

Narrator: officers bring 63-year-old gene in for questioning.

Turns out, the fitzpatricks felt philip gattuso

Was not up to raising their granddaughter.

They didn't feel that he was a good father.

They said they could do a better job raising her than he could.

Narrator: the kirkpatricks were determined
