Massimo Bossetti's trial has begun.

He's accused of murdering Yara Gambirasio.

[in English] They've been looking
for him for five years.

They finally caught him.

the only defendant.

He's guilty, in my opinion.

He's a pedophile.
We need justice to be done.

There will now be a trial.
That's where the real game is played.

His DNA was on her leggings.

By now, we all know
about the DNA evidence,

but we also know that it's not enough.

Other clues are necessary.

There must be proof
beyond any reasonable doubt.

We must show our children
that the bad guys gets punished.

Let them see what happens to the monster.

Eight members of the jury,

four women, four men,
six appointed, two deputies,

swore in at the first hearing of the trial
against Massimo Giuseppe Bossetti.

Silence fell when the builder accused
of k*lling Yara Gambirasio entered.

[in English] The court enters,
everyone stands, the defendant is present.

[Bertoja] The defendant is present,
as are both of his lawyers,

and lawyers Pelillo and Pezzotta

representing the plaintiffs,
the Gambirasio family.

-Prosecutor.
-[Ruggeri] Thank you.

[Massimo] That moment
was devastating for me.

Walking into a courtroom
and seeing all those people…

I was trying hard to

hold back tears.

I did not take my eyes off
prosecutor Ruggeri for even a second.

She made no eye contact with me.
Not a single time.

Because she's ruined my life.

LETIZIA RUGGERI - PROSECUTOR

[Ruggeri] You prefer to pass by
Brembate Sopra to stop at newsstands?

[Massimo] I took the longer route.
It was longer but smoother.

And I could stop at three newsstands.

[Ruggeri] So you stopped by these
three newsstands every night?

-[Massimo] Every night.
-[Ruggeri] What did you buy for your kids?

[Massimo] I'd buy stickers, small toys.
I've always bought all sorts of things.

[Ruggeri] You know,
we couldn't find a single newsagent

who said you had stopped by
to buy stickers or toys.

What happened in that courtroom at times

bordered on Kafkaesque.

the relevance of each question,

it becomes explaining
the answer to the witness.

[Bertoja] Mr. Salvagni, come on now.

[Ruggeri] Mr. Salvagni,
you can't interrupt me.

[Camporini] No, it's not true!

[Ruggeri] You can say
that during the debate.

[Camporini] She changes
according to what's convenient.

And I ask for the absolute utmost silence.

[Salvagni] It really should have
been allowed to be filmed.

Because people needed to know
what was going on inside that courtroom.

Unfortunately, that didn't happen.

of Bergamo forbids the use of cameras

in the courtroom where the trial is held

to protect family members
and underage witnesses.

[in English] When the trial began,
I struggled to get accredited.

I discovered we were in a courtroom
the size of a bonsai tree,

both physically and symbolically.

It must have been the most minute
courtroom in the whole of Lombardy,

with a gallery of 50 people
fighting to get in,

and limited access.

It seemed to me like being in a movie.

Like a Big Brother of justice,

and we were in a courtroom where,
in the third millennium,

we were expressly forbidden to record.

[Ruggeri] I believe that recording
the trial would seriously damage

the security of the testimony itself,

and that of the many witnesses.

Therefore, I reiterate
my non-consent in having it filmed.

I believe that cameras in the courtroom
is an expression of democracy.

Opinions are often based
on the fragments of information

that people get
from television broadcasts.

These fragments, being incomplete,

lead to absolutely
questionable conclusions.

[Telese] We were searched obsessively

to make sure we didn't have
any recording devices

and mobile phones,
which we had to leave behind,

and any other implements
that would allow us to collect evidence.

[mysterious music playing]

I tried to be present at all the hearings.

tooth and nail till the end?

Of course, definitely.

I'll… I'm just keep going and going.

When you have nothing to hide,
you can hold your head high.

[journalist 2] Are you comfortable
with this testimony?

Bossetti's relatives were
always present at the trial.

They have an innocent man locked up.
The real k*ller is still loose.

They should have done more for my son.

[Abrate] He was never deprived
of an affectionate look, or a smile.

And I see this as being human,
and that it should be respected.

Absolutely.
I think everyone deserves that.

What immediately surprised me,
from the very first hearing,

was not seeing poor Yara's
parents in the courtroom,

Mr. and Mrs. Gambirasio.

If one of my daughters had gone missing,

I'd never have missed a hearing. Never.

[tense music playing]

[Ruggeri] Okay, what did you do
on the evening of November 26th, 2010?

FULVIO GAMBIRASIO - YARA'S FATHER
RECORDING FROM TRIAL

[Fulvio] Around 7:55, Maura calls me
and says, "There's no one here."

"I'm here at the sports center,
and Yara's not here."

"I'm going back."

I began driving around the sports center,

and driving around
all of the backstreets in the area.

[journalist] The only thing we're certain
of is she was in the gym behind me.

She was there,
almost certainly, until 6:42 p.m.,

when she was seen in the lobby of the gym

by the father of a friend,
another rhythmic gymnastics athlete.

FABRIZIO FRANCESE
WITNESS

[Francese] I walked in front
of the windows of the swimming pools,

I entered the gym,
through the main entrance,

and I saw Yara there, coming towards me.

We crossed paths
and I continued walking toward the stands.

The feeling I had is that she had left
through that door over there.

-[Ruggeri] Through which you entered.
-[Francese] Through which I entered.

[Bertoja] Did you happen to hear
the door opening or closing?

[Francese] I don't know about that. No.

[Camporini] So you didn't see
Yara actually leaving.

-[Francese] No.
-[Camporini] Okay.

My opinion is that young girl
never left that gym.

EZIO DENTI
PRIVATE DETECTIVE - DEFENSE

If we ask ourselves whether the body
could have been hidden or concealed there,

my answer is yes.

There were all the conditions
available to do it,

the spaces where they could do it,

and the ideal light conducive
to hiding a body.

[ominous music playing]

[mysterious music playing]

[journalist 1] This field in Chignolo
d'Isola is one of the cornerstones

in the investigation
into Yara Gambirasio's death.

This small altar
is located a few hundred meters

from the place
where Yara Gambirasio's body was found.

And these flowers were put here in memory
of the k*lling of a young Dominican boy.

Between Yara's disappearance
and the discovery of her body,

a terrifying crime is committed
in the Sabbie Mobili nightclub.

[journalist 2] On Saturday night,
January 15th, 2011,

Eddie Castillo, a 26-year-old Dominican,

was k*lled as he left the nightclub.

Eddie Castillo is a foreigner,

therefore considered
perhaps of minor importance,

but this case reveals a paradox.

If that day, after finding his body,

the police had inspected
just a few meters away,

we would have been spared
so many doubts and so much controversy,

because they would have found Yara's body,

if it was actually there.

[mysterious music continues]

[journalist] In these
exclusive RAI images,

we see the searches carried out
by the civil protection volunteers.

This was on December 12th.

Coordinated by the police,
volunteers combed the area that day

near the wall running along the field
where Yara's body was found.

What did you say
at the prosecutor's office?

I went there to say
that we repeatedly passed by that area

and didn't see the body.

Many people were searching the area,

both in helicopters and on foot.

As I've said before,
if she'd been left there three months ago,

we would've found her already.

Hunters go there with setters,
and these dogs are attracted to blood.

I mean, they would have found her.

As far as I know,
the body was not hidden from view.

In my opinion, it couldn't be missed.

So, is the assumption that the body
was left here in the past few days?

I believe that's the case.

I don't think it's been there a long time.

[journalist 2] You haven't seen anything?

Not a thing,
because I don't think it was there.

[journalist 3] Doctor,
can you tell us what you're doing here?

-[Cattaneo] Absolutely not.
-[journalist 3] We just want to know.

[Cattaneo] No, I will not. For God's sake!

Ladies and gentlemen,
you've been told to stay behind the tape.

[Cattaneo] Everything we've reconstructed…

…leads us to believe that she died there.

She had grass
from that field in her hands.

According to the prosecution's thesis,

Yara, in her last spasm of agony,

clutches the grass
from that field in Chignolo.

[Ranalletta] I had objected
that that type of grass

is found in over three quarters of Italy.

It is not a strange orchid
from Madagascar.

DALILA RANALLETTA
FORENSIC DOCTOR FOR THE DEFENSE

It's a grass found everywhere.

I'm not rerunning the trial
on a documentary. No.

I think there were very few…
no, no flaws in our…

There were no flaws in,

in our investigations.

[Ranalletta] In this case, Cristina
Cattaneo has done an excellent job

at gathering evidence.

I do not agree with all the conclusions
that she arrived at.

In fact, I don't agree with any of them.

[journalist in Italian] The wounds
on Yara's skin have lime powder on them.

CRISTINA CATTANEO
RECORDING FROM TRIAL

[Cattaneo in English] This element
is frequently found in concrete

and reinforced concrete,

and it can also be connected
to construction materials

and things of that sort.

Lime with that type of chemical formula
alters itself with the slightest humidity.

You can't find that chemical formula.

It's not the lime commonly used
on construction sites.

It was essentially a calcium compound.

But which one? We don't know.

Oh, no, if you look at the records,
there was lime, there was cement,

and there's no doubt about that.

[Ranalletta] She claims it's material
used in construction, all right.

So, Yara had been there
no more than two hours.

-[Cattaneo] There're holes in the clothes.
-[man] There are holes?

[Cattaneo] Yes. They're folded.
I'd rather check them during the autopsy.

-I don't want to tear them.
-[man] No--

[Ruggeri] We don't have to come up
with a complex explanation.

All the wounds on the body
have a corresponding tear

found in the garment directly above them.

This compatibility and correlation between
the lacerations found on Yara's body

and those that were found on her clothes

is not that straightforward.

Far from it.

[journalist] For example,
Yara's body has a cut on her breast.

-[man] Which is this one, this cut.
-[Cattaneo] Yes, this one here.

[Ranalletta] About the laceration
on the front side of the body,

was it possible to see at first glance?

-[Cattaneo] No.
-[Ranalletta] No?

-[Cattaneo] You see by raising the shirt.
-[Ranalletta] Okay.

[Cattaneo] Look, see,
it was clearly made underneath the shirt.

-They're underneath.
-[man] Yes, There's nothing on top.

[Cattaneo] Nothing on the shirt.

[Denti] The prosecutor's office
hypothesizes

that the perpetrator
had to lift the jacket,

then lift her sequin sweatshirt,
and then her shirt,

so that he could get in
with a blade and cut her.

[man] The edge of the shirt
is white, isn't it?

If there was a cut,
wouldn't it have been blood-stained?

-[Cattaneo] Depends when it was inflicted.
-[man] I see.

They assume it was done on her naked body.

But did it happen there?

I think not. It was dark.

"What do we do, undress her?
Should we cut her,

and then dress her?

Why go to so much trouble,

and do all these things
to the body of a young girl?

[Massimo] I still think
that the real k*ller, or the K*llers,

are probably still free and…
are laughing at me and at justice.

A judge must guarantee a scientific
outcome that dispels all societal doubts.

This case is based on DNA
and Mr. Bossetti's total lack of an alibi…

…which obviously incriminate him.

[Salvagni] In addition to the DNA,

which was considered
the smoking g*n by the accusing parties,

the other incriminating evidence
is his presence in those areas.

The cell towers pinned down
Massimo Bossetti's phone

precisely in the areas around the gym.

[journalist 1 in Italian] The morning
hearing was spent analyzing cell towers.

His mobile phone pinged a cell tower
near Yara's home and gym several times.

[journalist 2] On that day, he wasn't
at home, as confirmed by his testimony.

At 5:45 p.m.,
his phone was located in the gym area.

ANTONELLA BERTOJA - JUDGE
RECORDING FROM TRIAL

[Bertoja in English] As the prosecutor
told you, on the evening of November 26th,

your phone linked up to a cell tower

located in an area
consistent with the location

of this girl's cell phone.

[Massimo] Mr. Salvagni told me
that my phone was pinged on my way home

at 5:45 by the same cell tower
that covers half of Brembate.

That man is there, the cell towers
place him in that location.

His DNA isn't there,
No, it's obvious, he's there!

[contemplative music playing]

[Abrate] The path of his van,

the cell towers pinged in the area
compatible with the gym's location,

these are all, let's say,
clues that in some way

lead back
to Bossetti's presence in that area.

[music fades]

[journalist in Italian] The underage girls
who would carelessly enter the gym

in Brembate five years ago,

have now turned 18
and are entering Bergamo courtroom.

Yara's friends and gymnastic trainers

have been summoned as witnesses.

[in English] As it happens,
there was a day

when Yara's friends were summoned.

It was an enormous surprise
for everyone, not just me.

They seemed to be following
a script of some sort.

Every single one of them
was saying the exact same thing.

[Camporini] That evening,
we're talking about the 26th.

-Did you see Yara leave the gym?
-[woman] No. Not actually leave.

YARA'S FRIEND

-[Camporini] We had said the time was…
-[woman] I don't remember the exact time.

[Camporini] I see.

[Bertoja] Did she mention
that she was late,

and her mother
was waiting for her at home?

[woman] I don't remember.

Did you see her heading
toward the exit? You don't remember.

[Ruggeri] Did you talk to her
directly about anything at all?

-[woman] No. I can't remember.
-[Ruggeri] No further questions.

"I don't know,
I don't remember, I don't know,"

were all over the records that afternoon.

There are two options.

Either they all lost their memories,

or we could assume
it was some sort of strategy.

[announcer] Yara Gambirasio
and Martina Dolci.

-[applause]

[Ruggeri] Apart from gymnastics,
did you talk about other things?

[woman] No.

[Ruggeri] You're sure
that you only talked about the gym.

MARTINA DOLCI
YARA'S GYM MATE

[Dolci] We'd mostly talk about gymnastics.
We were partnered up.

[announcer] Yara Gambirasio.
Martina Dolci.

They've won all the medals
in the regionals.

[Telese] This specific girl,
for us, was extremely important.

She was the one who had
gotten the last message Yara sent.


What time are we meeting on Sunday?


We should be there by 8.


Ok. Thanks. Bye.

[Ruggeri] What were these messages about?

[Dolci] I can't remember precisely.

She possessed the last piece
of evidence of Yara being alive.

How could you not remember that message?

[cheering and applause]

[Ruggeri] As far as you can recall,
was the gymnasium quiet that night?

[Fulvio] It was fantastic.
They all loved each other.

It was sort of idyllic, almost unreal.

[Telese] I remember watching one,
two, three, four of them.

This sequence of girls, at some point,

created a hypnotic feeling,
but also a need for something more.

The suspicion I had at that moment

was that they might
have known something more

about what Yara had done that night.

[dramatic music playing]

[Oliva] Dr. Cattaneo finds
some important DNA on the cuff

of Yara Gambirasio's jacket.

There was a bloodstain on that spot,
and the blood contained mixed DNA,

including Silvia Brena's.

And the question is, how did it get there?

-[Bertoja] Are you Silvia Brena?
-[Brena] Yes.

SILVIA BRENA
YARA'S GYM TRAINER

[Bertoja] Read the witness's oath.

[Brena] Aware of the legal responsibility
that I take upon myself with my testimony,

I swear to tell the truth
and not withhold any information.

[Oliva] Silvia Brena is one
of Yara Gambirasio's teachers.

On the evening of her disappearance,
Yara was at the gym,

bringing her speaker,
when Silvia Brena arrived.

She was coming from the university
and entered the room where Yara was.

[Ruggeri] You must have heard by now
that your DNA was found on Yara's jacket.

Can you explain this?

[mysterious music playing]

[Brena] I don't know.
Maybe while we were saying hi.

[Ruggeri] You hugged each other,
you kissed? please elaborate.

[Brena] It could have been
just a casual greeting with one arm.

-[Ruggeri] Mmm-hmm.
-[Brena] Not really a hug, per se.

They might've touched in the gym.
It's normal. She was her trainer. No.

Because according to the girls,

given the heat and the nature
of their exercises,

they had never worn
their jackets in the gym.

One could say, "Okay, what's the problem?"

They must've touched each other, and
the contact took place in the locker room,

as you would expect.

No.

Because, as strange as it may seem,

the Brembate gym
had two separate locker rooms,

one for the teachers
and one for the girls.

Then, one could say, "Okay, that contact
might've taken place in the evening,

because Silvia Brena was returning
from Milan and heading there."

No, because this contact is denied
by another crucial testimony.

That of Silvia Brena herself,
who says she had never run into Yara.

[Oliva] She didn't even speak
to Yara that afternoon.

It so happened that Yara stays in the gym
following the class with her speaker,

while Silvia Brena gets changed and goes
to do her workout somewhere else.

[man 1] It's quite normal
that Silvia Brena's DNA

is on the sleeve of the jacket.

[man 2] Why are you saying that?
There's no evidence of any contact

with that jacket
during the rhythmic gymnastics class!

Be reasonable.
There's logic to these things.

[Brena] I hope
I will be surrounded by people

who are not influenced
by this smokescreen,

and can see beyond what you hear
on TV and in the newspapers.

Silvia Brena cannot explain why her DNA,

out of the 11 strands found on the body,

was the only one undisputed
and uncontroversial,

and why it was present on such
a sensitive area as the cuff.

If you have to carry a body,
you'd drag it from there.

[Salvagni] Did you happen
to send your brother a text message

when you were already… at the gym?

[mysterious music playing]

[Brena] Probably. I don't remember.

[Salvagni] I can give you
the exact time, 6:35 p.m.

[Brena] I don't remember.

[Salvagni] You were asked by the
investigators if you sent this message,

and more importantly, if this
message had since been deleted.

[Brena] I don't remember that message.

Silvia sends her brother a message.

Her brother then replies.
Both of them delete the message.

So the question is, why do that?

[Salvagni] So you also don't remember
if your brother deleted it.

[Brena] I don't remember.

-[Salvagni] What time did you leave?
-[Brena] I don't remember.

[Salvagni] Can you not be precise?

[Camporini] You don't seem
to remember much. Try harder.

[Brena] Yeah, I know.

[Camporini] If you don't mind my saying,
this trial is very important.

[tense music playing]

[Salvagni] When you got home,
what happened?

[Bertoja] Mr. Salvagni, can you explain
to me the relevance of this?

[Oliva] The father said
his daughter was crying,

but she said she remembered nothing,
not even having cried.

What were these tears due to?

At that point, no one knew
that Yara was dead.

No one even knew for sure
that she had been kidnapped.

So why is she upset?

[Salvagni] Now, knowing
what you did that night,

when you went out, is very important.

[Bertoja] Mr. Salvagni,
I'm going to stop you here.

[Salvagni] Allow me to ask the question.

[Bertoja] No, I will definitely
not allow the question.

Either she really was the type of girl…
How can I say this?

…who collapses emotionally preemptively,

before receiving any news
to justify such a breakdown,

or else her emotions were affected
by an incident that we aren't aware of.

[Salvagni] Last question.
When you left the gym to go home,

did you notice anything unusual?

[Brena] I bumped into Valter on the bus.

[Salvagni] Yes,
Mr. Valter Brembilla was there.

[Brena] Yes, he's the caretaker.

Valter Brembilla is the caretaker
of the gym where Yara would train.

[Fulvio] He was always there.

He made the rounds, and just sort of
lent a hand when there were activities.

He knew Yara for sure
because apart from that, he knew--

[Salvagni] So did he know that Yara
was your daughter? That's the thing.

[Fulvio] Yes, when we prepared the gym
for meets, he was always there.

He knew she was my daughter.
He knew it for sure.

[Oliva] He has the keys to the gym,
the keys to all the rooms,

the cupboards,
the locker rooms in the gym.

He's the one who drives
the athletes back and forth in the van.

Brembilla is… a rough man,

who really fits into the cliché of a man
with nowhere to go and nothing to do.

[Brembilla] I'm not saying
anything, guys. Come on.

[Oliva] Let's just say Mr. Brembilla
could have played an important role.

He's the person who, on the evening
of Yara's disappearance, around midnight,

helped in the first round
of searches inside the gym.

VALTER BREMBILLA - GYM CARETAKER
RECORDING FROM TRIAL

[Brembilla] After midnight, the teacher
arrived along with two other people,

telling me that they couldn't find Yara.

And they asked me
if I could open the gym to check

if she had stayed inside, or something.

I entered the sports center,
turned on all the lights,

and we all looked around,
to see if she was… she was there.

The night she disappeared, they conducted
a lousy search inside this gym,

as if it were no bigger
than 400 square meters.

We're talking about thousands
of square meters,

considering the entirety of the premises.

[intriguing music playing]

[Salvagni] Can you walk us through
what you did that afternoon?

[Brembilla] Around 5:00 p.m.
I drove my van to pick up a guy

at the Ponte San Pietro station.

He was coming to train
at the sports center.

[Denti] This van that you can see here
belongs to the gym.

You may be asking,
what does it have to do with anything?

During the intensive work that was done
to analyze all of the footage,

we had also come across the vehicle
that was used by the caretaker himself,

and this finding was incompatible
with everything that had been said before.

[Denti] Why did he say that at 5:10 p.m.
he went back to the gym,

and left again at 7:30,

when we can see he was here at 6:33?

[Salvagni] Why did you change
your version about the events

that happened that night, several times?

[Brembilla] Well, I can't really remember
after five years.

[Salvagni] This was your statement
after five days.

[Brembilla] Yes.

[Camporini] Is there a reason why you made
a certain statement at the beginning,

-contradicting what happened later?
-[Brembilla] No.

[Camporini] You don't remember
the explanation you gave?

[Brembilla] No. Since I'm the caretaker,
you could've tried to blame me.

This left us definitely stunned,
to say the least.

Why were there no in-depth investigations
conducted into this person

when it would've been important?

[Ruggeri] It doesn't matter at all
what the caretaker did that day.

[Salvagni] The moment you--

[Ruggeri] Because he has neither
seen Yara nor anyone else, so--

[Salvagni] He hasn't said it yet!
He has not said it! It's a mystery.

-[Ruggeri] We already know--
-[Salvagni] You already know!

Let the court know what he saw.

-[Bertoja] He is not a defendant.
-[Camporini] For now.

-[Bertoja] Well, I--
